GSMA Mobile World Congress 2010
Terms and Conditions

Eligibility: The App Planet “Best of Show” Mobile Application Award Contest is open to any company exhibiting at Mobile World Congress 2010. Eligible companies include:

  • Mobile Network Operators
  • Application Developers (software companies)
  • Content Owners and Providers
  • Device manufacturers
  • Or partnerships between any of the above

All applications submitted as entries must be supportive of, or be deployed over mobile networks that use the GSM family of mobile technologies e.g. GSM, GPRS, EDGE, W-CDMA and HSPA. All applications submitted for this award must have been commercially available ahead of the awards deadline of 10 February 2010. The mobile application service can provided anywhere in the world.

Agreement: The Results. The rules and the decisions of the judges of the Awards will be final and binding in all respects. You agree to comply with and be bound by said decisions. To the extent permitted by law, the rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with the Awards are hereby excluded, and You expressly waive any and all such rights. If an entry is nominated for an award or receives an award, the manner and details of announcing such nomination and award is strictly within the discretion of the GSMA.

Deadline and Closing Date: The final closing date for entries to the App Planet “Best of Show” Mobile Application is 10 February 2010.

Entry Form Submission: Entries must be submitted online via https://vovici.com/wsb.dll/s/2538g42c0d. By submitting an entry, you agree that GSMA, its designees and the judges may use all information provided in the entry for the purposes of this competition. Further, the entrant's name and logo, as well as a screenshot(s) from or demo of the entry may be used for advertising, promotional, and other purposes and you consent to such use. Acceptance of an award constitutes permission for, and winners consent to, GSMA and its agencies to use a winner's name, likeness and entry for advertising and promotional purposes without additional compensation, unless prohibited by law.

Language: Entries will only be accepted when submitted in the English language.

Multiple Entries: There are no maximum number of entries permitted from a single organisation. You can submit as many different entries to as you would like.

Entry Fees: There is no fee payable to submit an entry.

Originality: You certify that your entry is original and that you are the sole and exclusive creator, owner and rights holder of the submitted entry and that you have the right to submit the entry in the Awards. You agree not to submit any entry that (1) infringes any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; (2) otherwise violates applicable law; or (3) is subject of any actual or threatened litigation or claim. You shall indemnify GSMA and its affiliated entities, assigns and licensees against any loss, cost or damage (including reasonable attorneys' fees) arising out of or in connection with any breach of any of the aforesaid representations, warranties or agreements.

Delay, modification or cancellation: If for any reason the competition is not capable of running as planned due to acts beyond the control of GSMA, including acts of force majeure, acts of war, domestic terrorism, fraud, technical failures, or any other causes beyond the control of GSMA, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the competition, GSMA reserves the right at its sole discretion, to delay, modify or terminate or cancel the competition without any liability.

No Warranty: Submission of an entry that meets all eligibility requirements by the relevant deadline ensures that the entry will be reviewed and considered an entrant into the competition. No other representation or warranty is made concerning entries and all implied warranties are hereby expressly disclaimed. In no event shall the GSMA, its affiliates, directors, officers, employees, attorneys, agents and representatives be responsible or liable for any damages or losses of any kind, including direct indirect, incidental, consequential or punitive damages arising out of participant's access to and use of this website or entry into the Awards.

FOR THE AVOIDANCE OF DOUBT, THE COMPETITION IS BEING RUN "AS-IS." YOU BEAR THE RISK OF ENTERING THE COMPETITION. YOU EXPRESSLY AGREE THAT ENTERING AND PARTICIPATING IN THE COMPETITION IS AT YOUR SOLE RISK. NEITHER GSMA, ITS PARENT, ITS AFFILIATES, NOR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS, OR THE LIKE, WARRANT THAT THE COMPETITION WILL BE UNINTERRUPTED OR ERROR-FREE; NOR DO THEY MAKE ANY WARRANTY OR REPRESENTATION AS TO MAINTAINING THE CONFIDENTIALITY OF ENTRY MATERIALS SUBMITTED; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS TO BE CAUSED BY PARTICIPATION IN THE AWARDS AND/OR USE OR ACCEPTANCE OF ANY AWARD WON.

Hold Harmless: You release and hold harmless the judges and GSMA (including its affiliates, directors, officers, employees, attorneys, agents and representatives) from any and all liability for any injuries, loss, claim, action, demand or damage of any kind rising from or in connection with the competition, or any prize won, any use of the entry materials by GSMA. GSMA assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. GSMA is not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant's or to any other person's computer related to or resulting from participating or uploading data, images or information for the Awards.

Governing Law: This Agreement and the rights and obligations of the parties are governed by and construed in accordance with and subject to the laws of the State of Georgia, without reference to conflicts of laws principles. The parties hereby irrevocably submit to the exclusive jurisdiction of the Courts of the State of Georgia and the Federal Court of the United States of America in the State of Georgia.

Additional Supporting Materials: Additional materials are not accepted.

Judging Process & Criteria: Judges will visit each entrant’s exhibition stand between, 09:00 Monday 15 Feb and 16:00, Tuesday 16 February 2010. The panel will convene on Tuesday, 16 February to select a winner having considered all entries. The winner will be announced on Wednesday, 17 February 2010. Entries will be judged on the basis of the information provided to the independent judging panel on the entry form (https://vovici.com/wsb.dll/s/2538g42c0d), and the entrants demonstration in accordance with the criteria listed below. Details of the composition of the judging panel and the content of judging panel meetings will not be disclosed.

No correspondence will be entered into by the GSMA regarding validation or qualification of entries.
Mobile applications must be commercially available to be considered and must have been launched prior to, or at, GSMA Mobile World Congress 2010. The mobile application must be available in at least one country/market. Failure to provide such a demonstration on request, for any reason, including lack of booth personnel, is sufficient to disqualify an application from the competition. Entries for the App Planet "Best of Show" Mobile Application Award competition will be judged on the following criteria:

  • Compelling experience for users
  • Quality of the demonstration
  • Genuine innovative or unique in terms of a breakthrough in technology, graphics or usability
  • Good use of mobility, e.g., location-based services
  • 'Cool factor' (e.g., consumer content delivered) or business productivity delivered (e.g., SFA application integrated with a “cloud” back-end data center)
  • Ease of use.
  • Value for money

Disqualification: GSMA reserves the right in its sole discretion to disqualify any entrant it finds to be: (1) tampering or attempting to tamper with the entry process or the operation of the competition; (2) in breach of these Rules; or (3) in the sole opinion of GSMA, acting in an unfair manner. If a winner is disqualified, GSMA may select an alternate winner.

Winners: The decision of the judges is final. No correspondence will be entered into. The App Planet “Best of Show” Mobile Application winner will be announced on Wednesday, 17th February.
